Policies & Terms of Use

Our Obligations & Limitations

We are responsible for advertising the space accurately and having the rented space ready for your use for the time allotted. Because there is always the possibility of unexpected equipment malfunctions, we cannot guarantee all the advertised features are available. Please let us know if anything is not working or ceases to work. We will make reasonable accommodations if there are problems with the space, time, or equipment included in the space rental at our discretion, including partial or entire refunds. We are in a building that has neighboring offices and shops and therefore cannot guarantee prevention of external sound entering the rental space. Our responsibilities are limited to the offerings specifically described on our website corresponding to the space you book.

Your Responsibilities

We clean and organize the space before you get here. It is your responsibility to leave the place in a reasonable condition. If there is an excessive mess, you are responsible for cleaning it or paying a cleaning fee proportionate to the cost to clean it professionally. You will pay for any damage or undue costs to us caused by you or your group. Personal items lost, abandoned, trashed, or otherwise left behind are your responsibility. If we find something of yours, we may hold it and/or contact you out of courtesy and at our discretion.

Conduct

Use of drugs, tobacco, or alcohol is prohibited. No cooking is allowed on site (microwave and toaster are fine). No firearms, incendiary devices, explosives are allowed on site. No illegal activities allowed on or near the site. An adult of your party must be present at all times when any of your party is on site. The client will be held accountable and charged for: damages beyond normal wear & tear, theft, excessive messiness, and/or other unreasonable conduct or misuse of the space. You agree to abide by local fire code and any other applicable laws that regulate the maximum occupancy of rooms. Additionally, you must not allow for there to be more people in our rooms than is safe or comfortable for all those involved.

Space Usage

Each specific booking you select will grant you access to specific limited areas/spaces and specific equipment at our site. The spaces provided are designed for specific purposes and to use them for anything other than their intended purpose violates our agreement. Similarly, the equipment provided needs to be used as is appropriate to the space. As creative as it may be to make a teepee out of our lighting equipment and backdrops, it would unfortunately be a violation of this rule. The front office of the site is strictly off limits to your party. The warehouse/storage portion of the site is only accessible to those needing access to the infinity wall room or equipment therein. If you are unsure if your intended usage is appropriate for the space rented, please clarify with us for approval before your booking. 

Equipment

There is a variety of equipment, furniture, and other items provided as per the space being booked. There is equipment that is not included in the booking but can be added for an additional fee. These are rentable through the booking process. You are responsible for careful handling of all our equipment and must report any damage immediately. Feel free to bring your own equipment, props, and furniture so long as they are not a danger or liability to us.

Amenities

We try our best to maintain our supplies stocked, but we cannot guarantee everything will always be fully stocked. If there is anything essential missing (e.g., toilet paper), let us know immediately. The tea, coffee, cups, and other supplies are intended for use by you and your party while on the site and during your booked time. Our supplies are not to be used for anything other than their intended purpose. Our temperature control is set to be comfortable for everyone in the building. Feel free to request any changes to our thermostat, but do not make modifications yourself without permission. The restroom is shared with our on-site staff. If the water dispenser jug needs replacement or there are any issues with our amenities, let a staff member know.

Rentals & Extensions

You must use our online booking process through this site to make a reservation of our space. If you decide you need to modify your booking length, please do so on-line 24 hours prior to your start time (assuming more time is available). Bookings may not be modifiable within 24 hours of the reservation. If you decide you need more time while on site or within 24 hours of your start time, let us know and we may accommodate your request. Please realize that it may not be possible to accommodate such requests due to schedule conflicts with other bookings or with staff hours that day.

Cancellations & Refunds

You may cancel your booking for full refund, but not within 24 hours of your scheduled start time. Cancellations within 24 hours of your scheduled start time will not qualify for a refund. We will do our best to make sure your scheduled space is ready on time and uninterrupted. If unforeseen circumstances, uncontrollable conditions, or anything prevents your space from being available the entire time you have booked, you are entitled to a full or pro-rated refund based on the time you were not allowed to use the space. Though we have no intention to cancel or reschedule reservations, due to unexpected circumstances, we reserve the right to cancel or reschedule any booking for any reason at any time. In the event we have to cancel or reschedule bookings, we may offer to reschedule or offer another form of compensation at our discretion. No compensation is granted for loss of time, costs associated with your event, or losses, etc., resulting from any cancellation or unavailability of the space. Sharing rental periods with other parties must be approved with at least a 24 hour prior notice. Unreasonable excessive booking cancellations or rescheduling are unacceptable.

Covid-19

We take reasonable measures to protect ourselves and our guests from contracting coronavirus/COVID-19. We have a sanitization procedure to clean the rental spaces before your arrival. We have sanitizing/cleaning/protection products available for your use when on site (wipes, masks, etc.). You are responsible to prevent any party member (including yourself) from coming on site if there is a reasonable suspicion that person may have COVID-19. You will not bring anyone on site who is exhibiting known covid-19 symptoms, such as: cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. If a party member is recovering or has recently recovered from COVID, they must be cleared as non-contagious by health professionals before coming on site. 

By renting any space with us you release and agree to hold harmless Murrieta Creative and associated entities from any contractions of COVID-19 (or similar viruses) and any damages, costs, or claims, etc. related to such contractions.

Media Rights

We make no ownership claims/rights to any of your created media. If you share your creations with us, we assume your permission to freely use or share your media on our website, media channels, etc. If you would like to restrict our usage of media you share with us, please make it clear, preferably in writing, and we will respect your wishes.

Maximum Capacity

You agree to abide by local fire code and any other applicable laws that regulate the maximum occupancy of rooms. Additionally, you must not allow for there to be more people in our rooms than is safe or comfortable for all those involved.

Payments & Fees

Booking fees are due at the time of booking with no exceptions. You are liable to pay other fees or costs that are agreed upon and or covered in these policies. In the event there are additional charges incurred after your booking payment is completed, you are required to pay for these separately and within a reasonable amount of time. These additional fees may include charges for cleaning, damage, overstays, or additional rented equipment.

Please note, all rentals require a valid credit card on file for liability purposes

Pets & Animals

We do not allow pets on site unless they are to be featured in your creative productions. All pets allowed on site must be well behaved and supervised. We respect all legal rights of those with service animals. Please let us know in advance if you plan to bring animals to your event.

Privacy

We intend to let you work uninterrupted as you please when you are here. Feel free to close the doors to the production rooms (infinity wall room and podcast room). These rooms do not have security/surveillance cameras. There are cameras in our warehouse and meeting room. Your informed consent of you and your party to be recorded onsite by these cameras is implied with any booking. If you have special privacy needs, please let us know so we may accommodate your reasonable requests.

Violations

In the unfortunate event that we feel our policies were violated or it appears there are/were intentions to violate them, we reserve the right to cancel your booking and expel your party immediately and refund any of your payment at our sole discretion. 

Definitions

In this contract, Murrieta Creative and agents thereof are referred to as “us,” “we,” and “host.” You, as the client and associated guests, are the other party to this contract and are referred to as “you,” “guests,” “client,” “party,” or a similar reference. These rules, policies, and terms apply to you and your guests. The word “site” refers to the physical location of Murrieta Creative’s building and associated areas. The term “on site” directly refers to our previously defined “site.” The word “space” refers to various rentable areas and associated areas within the building. The word “event” refers to your booked time, any time you are on site before or after your booked time, and any of your party’s activities during that time. This contract is to be executed as a layman would interpret the intention of the rules if there are any grammatical or technical errors herein.

Indemnity & Release

Guests acknowledge and understand that, to the fullest extent allowed by law, they are using our space at their own risk. Except as otherwise provided by law, we shall not be liable, and you expressly waive any claim of liability for personal injury or property damage, which occur to you or any attendee at our site and/or during your event. This waiver includes, but is not limited to any loss, damage, or destruction of the personal property of you or any attendees and is intended to be a complete release of any responsibility for personal injury and/or property damage sustained by you or your attendees resulting from use of our space or equipment/items therein.

You will indemnify, defend, pay, and hold us (Murrieta Creative and associated entities) harmless from and against all third-party claims, liabilities, losses, damages, and related expenses (including reasonable legal expenses) arising from or related to (a) our provision of rental spaces and their inclusions; (b) content you provide to us; (c) your failure to comply with laws and/or our rules/policies; (d) your provision of information to us that is inaccurate or incomplete (e.g., wrong booking details); (e) your breach of any of your representations or obligations under this agreement; (f) any contract or other agreement between you and any other party; and (g) any bodily injury (including death) or damage to tangible or real property to the extent caused by you or your attendees. The limitation of liability set forth above applies to the fullest extent permitted by law.

Agreement

You agree to comply with our policies and all governmental laws, rules, and regulations applicable to the space. Agreements between client and host may override our policies only if they were established prior to booking and qualify as a legally qualifying agreement under contract law. We do not offer or require any insurance for your booking. Only adults (18+) may book with us. By renting any space with us you are accepting these terms and agreements and are held responsible for upholding your end of the responsibilities it places on you and your party.
